Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.

  • Consumer: A natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur.

  • Day: Calendar day.

  • Continuing Transaction: A distance contract concerning a series of products and/or services, where the delivery and/or purchase obligation is spread over time.

  • Durable Medium: Any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future reference and unaltered reproduction.

  • Right of Withdrawal: The option for the consumer to withdraw from the distance contract within the cooling-off period.

  • Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.

  • Distance Contract: A contract concluded within the framework of an organised distance sales system, using one or more techniques for distance communication, without simultaneous physical presence of the entrepreneur and the consumer.

  • Technique for Distance Communication: Any means that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place.

  • General Terms and Conditions: These present General Terms and Conditions of the entrepreneur.


Article 3 – Applicability

These Terms and Conditions apply to every offer from Seed&Wild and to every distance contract and order concluded between Seed&Wild and the consumer.

Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed before the contract is concluded where the Terms and Conditions can be inspected, and that they will be sent free of charge upon request.

If the contract is concluded electronically, the text of these Terms and Conditions will also be made available in such a way that the consumer can store them on a durable medium.

If specific product or service conditions apply in addition to these Terms, the provisions of these Terms shall apply correspondingly. In the event of conflicting conditions, the most favourable provision for the consumer shall apply.

If any provision is found invalid or annulled, the remaining provisions remain in force, and the parties will agree on a replacement provision that approximates the original intent as closely as possible.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

The offer will include a complete and accurate description of the products, digital content, and/or services. Images used will be a truthful representation of the offered items. Obvious mistakes or errors do not bind Seed&Wild.

The offer will specify the rights and obligations involved in accepting it, including:

  • Price (including taxes).

  • Delivery costs.

  • Method of contract conclusion.

  • Whether the right of withdrawal applies.

  • Payment, delivery, and performance terms.

  • Duration of the offer or guarantee period for the price.

  • Technical means for error correction.

  • Available contract languages.

  • Applicable codes of conduct.


Article 5 – The Contract

The contract is concluded at the moment the consumer accepts the offer and meets the stated conditions.

When acceptance is made electronically, Seed&Wild will promptly confirm receipt electronically. Until confirmation is received, the consumer may dissolve the contract.

Seed&Wild will take appropriate measures to secure electronic transactions and ensure a safe online environment.

Seed&Wild may, within legal limits, assess whether the consumer can meet payment obligations and gather relevant information for responsible contract conclusion. If justified, the entrepreneur may refuse an order or attach special conditions.

Upon delivery, the following information will be provided in writing or on a durable medium:

  • Contact address for complaints.

  • Conditions and method for exercising the right of withdrawal.

  • After-sales service and warranties.

  • Requirements for termination of long-term contracts.

  • The withdrawal form (if applicable).


Article 6 – Right of Withdrawal

For Products: The consumer has 14 days from the day after receipt to withdraw without stating reasons. For multiple products ordered together, the period starts when the last item is received.

For Services and Digital Content (not supplied on a tangible medium): The consumer has 14 days after conclusion of the contract to withdraw without stating reasons.

If Seed&Wild fails to inform the consumer of their right of withdrawal, the withdrawal period is extended by 12 months. If the missing information is provided within that time, the withdrawal period ends 14 days after receipt of that information.


Article 7 – Consumer Obligations During the Cooling-off Period

During this period, the consumer must handle the product and packaging carefully and only use it as necessary to determine its nature, characteristics, and functioning—similar to inspection in a store.

The consumer is liable for any reduction in value if they handle the product beyond what is permitted.


Article 8 – Exercising the Right of Withdrawal

To exercise the right of withdrawal, the consumer must notify Seed&Wild in an unequivocal statement. If provided electronically, Seed&Wild will confirm receipt without delay.

The consumer must return the product within 14 days of withdrawal. Return costs are the consumer’s responsibility unless otherwise stated.

Seed&Wild will refund all payments, including delivery costs (except additional costs from non-standard delivery methods), within 14 days of receiving the returned goods or proof of return. Refunds will be made using the original payment method.


Article 10 – Exclusions to the Right of Withdrawal

Seed&Wild may exclude the following, provided this is clearly stated before the contract is concluded:

  • Customised or personalised products.

  • Perishable goods.

  • Sealed products not suitable for return due to hygiene/health protection once opened.

  • Goods irrevocably mixed with other items after delivery.

  • Audio/video recordings or software with broken seals.

  • Newspapers, magazines (excluding subscriptions).

  • Accommodation, transport, catering, or leisure services for a specific date.


Article 11 – Pricing

Prices will not be increased during the validity period, except for changes in VAT or costs beyond Seed&Wild’s control. Prices include VAT.


Article 12 – Conformity and Warranty

Seed&Wild guarantees that products and/or services conform to the contract, specifications, reasonable usability, and applicable laws. Any additional warranty provided does not affect statutory rights.


Article 13 – Delivery and Execution

Seed&Wild will take the utmost care in receiving and fulfilling orders. Deliveries will be made to the address provided by the consumer.

Orders will be fulfilled promptly, no later than 30 days, unless agreed otherwise. If delivery is delayed or impossible, the consumer will be notified within 30 days and may cancel the order with a full refund.

The risk of damage or loss transfers to the consumer upon delivery unless otherwise agreed.


Article 14 – Long-term Contracts and Termination

Consumers may terminate indefinite contracts for the regular supply of products or services at any time with a maximum notice period of one month.

Contracts for a fixed term may be terminated at the end of the term with the same notice period.


Article 15 – Payment

Unless otherwise agreed, payments must be made within 14 days after the start of the cooling-off period.

Consumers cannot be required to prepay more than 50% of the purchase price.


Article 16 – Complaints Procedure

Seed&Wild maintains a clear complaints procedure. Complaints should be submitted promptly, fully, and clearly described.

Complaints will be answered within 14 days. If more time is required, the consumer will be informed of the expected resolution time.

If a complaint cannot be resolved mutually, it can be submitted to an independent dispute resolution body.


Article 17 – Disputes

All agreements are governed by Dutch law. Disputes may be submitted to Stichting GeschilOnline or the competent Dutch court.


Article 18 – Additional Provisions

Any additional provisions must not disadvantage the consumer and must be documented in writing or on a durable medium accessible to the consumer.
